“Condoms are NOT a crime! Use them every time.”

condom-mockup_070412As you may already know, St. James Infirmary has been working for the past several years to end the policy of the SFPD and SFDA of using condoms as evidence against sex workers and transgendered communities. After a 180 evaluation period, the SFDA has agreed to not use condoms as evidence or prostitution any longer, and the SFPD has issued a department wide bulletin to go along with the new policy, to not use condoms as evidence of soliciting or loitering in prostitution related cases.

This is a huge victory for our community.  Thanks to everyone at Human Rights Watch, the Human Rights Commission, the SF AIDS Office, the SFPD, SFDA and the Public Defenders Office for supporting this new policy.  Now we need to make this policy happen at the State level!

Please join us in supporting Tom Ammiano’s bill AB 336 which states that possession of condom(s) shall not be used as evidence of soliciting or engaging in prostitution (AB 336 – Fact Sheet – Condoms As Evidence)

We were recently informed that the hearing for bill AB 336 is scheduled for this Tuesday, April 22.  The practice of using condoms as evidence creates widespread harm – creating a faction of our society who are punished for engaging in safer sex practices while we spend millions on HIV prevention.
